BRPTO updates the rules for the registration of trademarks of names of individuals or signatures thereof and images of third parties

The Brazilian Patent and Trademark Office (BRPTO) has announced an important update to the Trademark Manual as of August 21, 2024.

The highlight of this update is the guidelines established on cases in which an explicit authorization is required to register a name, signature or image as a trademark.

This rule is in line with Article 124 XV, which states that civil/personal names, signatures, surnames, patronymics, and images of third parties cannot be registered as trademarks, without the consent of the holder of the right, his heirs, or successors.

In order to improve the efficiency of procedures and user guidance, the Manual will now be updated on an ongoing basis.
