Telecommunications inventions in Brazil: PPH program updates

The Brazilian Patent and Trademark Office (BRPTO) announced on March 25, 2025, the updated criteria for receiving PPH requests in 2025 related to the field of Telecommunications.

The previous Ordinance No. 26, dated December 23, 2024, will be revoked as of April 1, 2025.

Accordingly, the recently published Ordinance No. 03, dated March 24, 2025, establishes the following key updates:

  • Telecommunications field: 140 PPH requests will be accepted for patent applications whose main classification is IPC H04 (Telecommunications).
  • Application deadlines and calendar: 800 PPH requests will be available each semester, in addition to those offered in the first semester, reaching a total of 3,200 requests in 2025.

As a result, previous restrictions on IPC Specific Classifications, namely the IPC H04, have been removed. Between January and March 2025, the Brazilian PTO received about 730 PPH requests.

These changes reflect the Brazilian PTO's commitment to streamlining the patent prosecution process and fostering innovation in Brazil.
