Royal Decree-Law 23/2018, of December 21, on the transposition of directives related to trademarks, rail transport and travel packages and related travel services was published in the Official State Gazette (BOE) of December 27. This Royal Decree-Law, in its Title I, amends the current Trademark Law, Law 17/2001, of December 7.This amendment to the Law will become effective on January 14, 2019 in nearly all of the articles thereof, with one exception, which we will discuss, which has an effective date that is delayed until January 14, 2023.This law entails the nearly literal transposition of the content of the Directive (EU) 2015/2436 of the European Parliament and of the Council, of December 16, 2015 related to the approximation of the laws of the Member States relating to trademarks. The enactment of a new Trademark Law has been discarded upon considering that the content of said Directive did not affect the entire Law in force, thus opting for an amended law. The amendments made refer to fundamental questions relating to trademark law and especially procedural questions relating to the registration procedure, being those that we consider to be of greater interest to you and which we discuss below.

Since the recent enacted amendments to the Mexican Industrial Property Law (IPL), there have been some discussions related to the applicability of some provisions. This is basically due to the fact that the Rules of Implementation have not been approved yet.
By virtue of the present communication, we would like to clarify some of the main amendments and their impact in your applications and registered trademarks.

We are glad to present you the following publication summarizing the main legislative developments occurred in Spain, European Union (EU) and Latin America in relation to Intellectual Property practice during 2017 and the beginning of 2018.
Among the many relevant changes we outline below, 2017 was an intense year in Spain, with the entry into force of a new Patent Law (Law 24/2015, of July 24) on April 1; in the EU, with the latest revised version of the European Patent Office (EPO) Test Guidelines, effective as of November 1, the entry into force of the Regulation (Regulation (EU) No. 2015/2424 of the Parliament and the European Council of December 16, 2015) and the latest news about BREXIT and IP; lastly, in Latin America, where there have been substantial changes in the main jurisdictions of the region, especially in Argentina and Brazil.

On January 11, 2018, the Argentine Government published Decree No. 27/2018, whose purpose is essentially to simplify and reduce the length of proceedings before public institutions. A few days later, on January 16, 2018, the National Institute of Industrial Property ("INPI") published Resolution No. 1/2018, partially implementing some of the resolutions of Decree No. 27/2018 that affect procedures before the INPI, relative to trademarks as well as patents and designs.
